Special conditions governing the use of the service UBS Mobile Banking
These "Special conditions governing the use of the service UBS Mobile Banking" constitute an integral part of the agreement regarding the use of UBS Online Services (particularly the "Basic provisions for UBS Online Services"). In the event of contradictions, these special conditions shall prevail for the service UBS Mobile Banking.
Special conditions governing the use of the service UBS Mobile Banking
1. The service UBS Mobile Banking allows you, by using the UBS Mobile Banking app, to display information on your end device via an encrypted communication channel; which information may include for example your accounts, custody accounts, portfolios and transactions, such as payments and orders to trade in securities. To use the service, download the UBS Mobile Banking app (if necessary from a third party provider) and install it on your end device. Then start the UBS Mobile Banking app on your end device and gain access by using your personal means of authorization you have been provided with (contract number, password or UBS access card). The UBS Mobile Banking app also allows you to scan in pay-in slips using your end device and either store them or execute the payment directly. This function is available only if in the agreement regarding the use of UBS Online Services includes at least the authorization to enter payments.
The services and products, like for example accounts, custody accounts and portfolios for which you would like to receive information on your end device must be covered under the agreement regarding the use of UBS Online Services and must be selected individually.
2. The use of the service UBS Mobile Banking, amongst others due to the download, installation and/or use of the UBS Mobile Banking app and the associated reference points with third parties (e.g. Apple, network provider, device manufacturer), involves risks, particularly: (1) disclosure of the banking relationship and client information to third parties (e.g. in the event that the end device is lost or information regarding the download or the use of the UBS Mobile Banking app is stored by Apple Inc. and foreign (particularly US) authorities therefore gain access to the information), whereby the banking secrecy can not be ensured anymore in this respect; (2) system outages and other transmission errors, which can cause information to be delayed, mutilated, misrouted or deleted; (3) misuse of information intercepted by third parties resulting in damages; (4) disclosure of information in the event that an end device is lost; (5) transmission of false or manipulation of scanned-in pay-in slips.
You furthermore acknowledge that the information provided by UBS is provisional and non-binding and that the display of information in the UBS Mobile Banking app may differ from its display in other UBS Online Services, e.g. UBS E-Banking. Regarding this point, see sections 6 (Information from machines, terminals, monitors and other EDP systems) and 10 (Transmission errors, technical faults, breakdowns and illegal intrusions) of the "Basic provisions for UBS Online Services".
3. For the use of the UBS Mobile Banking service, UBS grants you the non-exclusive, non-transferable, free right to download the UBS Mobile Banking app (if necessary, from an authorized third party), install it on an end device in your possession and under your control and use it as part of the service UBS Mobile Banking.
The UBS Mobile Banking app may contain software that has been licensed by third parties. You acknowledge and accept the rights of UBS and of third parties, if applicable, to the UBS Mobile Banking app.
UBS accepts no responsibility for the functioning and operation of the UBS Mobile Banking app. In particular, UBS is under no obligation to update, otherwise improve, extend or support the UBS Mobile Banking app. UBS reserves the right to delete the UBS Mobile Banking app from the end device at any time without notice or to have it deleted.
Furthermore, UBS provides no guarantee that the UBS Mobile Banking app will work without errors on the end device and with your network operator.
4. Once successfully entered onto the UBS Mobile Banking app, the contract number is stored on the end device. By using the UBS Mobile Banking app, you acknowledge that the contract number is saved as client information at your own risk (see section 2).
5. You are aware of and accept the inherent risks of the service UBS Mobile Banking, including in particular the risk of disclosure of the banking relationship and client information to third parties (see section 2), and release UBS from any liability for losses or damages resulting from the use of the service UBS Mobile Banking as well as the download, installation and/or use of the UBS Mobile Banking app (e.g. in the event that an end device is lost) , to the extent permitted by law.
UBS provides no warranty and accepts no liability that the information displayed on the end device is up-to-date, correct and complete.
6. UBS may change or discontinue the scope of the service or the service in its entirety at any time without prior notice. Regarding this point, see sections 9 (Country-specific restrictions, foreign import and export restrictions) and 16 (Contractual modifications) of the "Basic provisions for UBS Online Services".
7. UBS provides the service UBS Mobile Banking free of charge, but reserves the right to introduce a compensation/fee for this service at a later date.
Charges for Internet data transfer (including roaming) will apply in accordance with your agreement with your respective network provider. Please contact your respective network provider for any questions concerning such charges.
8. You authorize UBS to use any information processed in connection with the use of the UBS Mobile Banking app (e.g. personal data, geographic information, device information) in the context and for the purpose of providing the service UBS Mobile Banking within UBS. UBS gives you the option to revoke this authorization.
9. Additionally, the Terms of use and Privacy statement, the Country-specific legal information and restrictions and the other page-specific information and notes contained on the individual web pages shall apply. Please read these carefully.
